End User License Agreement

1. What this agreement covers

This End User License Agreement ("EULA") is a license from Tuneless.tech ("we", "us", "our") to you, governing your right to access and use the Tuneless software (the web application, its client-side code, and any associated APIs — collectively, the "Software").

This EULA covers the license to the Software itself. It does not replace our Terms of Service, which governs purchases, tune-session quotas, engine-damage risk, warranty disclaimers, and liability limits. Where this EULA is silent, the Terms of Service controls. If the two documents ever conflict on a liability or disclaimer question, the Terms of Service governs — we maintain the substantive risk terms in one place to avoid the two documents drifting out of sync.

2. License grant

Subject to your compliance with this EULA and the Terms of Service, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Software through a supported web browser, solely to:

  • View telemetry and diagnostics from a compatible ECU that you own or are authorized to modify;
  • Generate and, where your account tier permits, apply AI-assisted tuning suggestions to that ECU; and
  • If you hold a Professional Installer subscription, provide tuning services to your own customers using the Software.

This is a license to use the Software, not a sale. We retain all rights not expressly granted here.

3. Restrictions

You agree not to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying protocol map, AI prompts, or tuning algorithms of the Software, except to the limited extent applicable law makes this restriction unenforceable;
  • Copy, redistribute, sublicense, rent, lease, or resell the Software;
  • Use the Software to build or assist in building a directly competing product or service;
  • Remove, obscure, or alter any proprietary notices on the Software;
  • Circumvent or attempt to circumvent any tier gating, usage limit, or write-safety gate built into the Software; or
  • Use the Software to interact with any hardware you do not own or are not authorized to modify.

4. Ownership

The Software, including its code, design, user interface, and the protocol-decoding and AI-tuning logic it embodies, is owned by Tuneless.tech or its licensors and is protected by copyright, trade secret, and other intellectual property laws. Nothing in this EULA transfers any ownership interest in the Software to you.

5. Third-party components

The Software relies on third-party services — including AI model providers, authentication, and payment processing — to operate. Your use of the Software is also subject to those providers' own terms where applicable (for example, an AI provider's acceptable-use policy for generated content). We are not responsible for the availability or behavior of third-party services outside our control.

6. Updates

Tuneless is a web application. We may update, patch, or modify the Software at any time without prior notice. Continued use of the Software after an update constitutes acceptance of the updated Software under this EULA.

7. No warranty; limitation of liability

The Software is licensed "AS IS" under the same disclaimers, warranty exclusions, and liability limitations set out in Terms of Service §10–§12, which are incorporated into this EULA by reference.

8. Term & termination

This license is effective until terminated. It terminates automatically, without notice, if you breach Section 3 (Restrictions). We may also terminate this license if we terminate your account under the Terms of Service. On termination, you must stop using the Software; provisions of this EULA that by their nature should survive termination (Sections 3, 4, 7, and 9) will survive.

9. Governing law

This EULA is governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles, consistent with the Terms of Service.

10. Entire agreement

This EULA, together with the Terms of Service, Privacy Policy, and Refund Policy, constitutes the entire agreement between you and Tuneless.tech regarding the Software and the Service.
